Why Trademark Watching Matters: The Cost of a Missed Window

Many companies file, receive the certificate and forget the file until renewal. But a trademark keeps its value through enforcement, not paperwork — and in Türkiye the key instrument is systematic monitoring of the Official Trademark Bulletin.

The Office will not tell you

No notification is sent when a confusingly similar application is published. The two-month opposition window runs from publication whether or not you noticed. Once it closes, your only route is invalidation before the courts — years of proceedings against what would have been a modest opposition fee.

And then acquiescence

The heavier consequence comes later: if you knew, or should have known, of a later mark’s use and stayed silent for five years, you generally lose the right to invalidate it at all. Not noticing eventually consumes the right to object.

What watching covers

  • Screening published applications for visual, phonetic and conceptual similarity.
  • Assessing whether the overlap is real — not every similarity warrants opposition.
  • A recommendation: oppose, monitor, or ignore.
  • Portfolio deadlines: renewals and files where proof of use may be demanded.
  • Market sweeps beyond the register: marketplace listings, domains, social accounts.
