Trademark Renewal in Türkiye: What Happens at Year Ten

Turkish trademark protection runs for ten years from the filing date and can be renewed indefinitely in ten-year terms (Article 23). Miss the renewal and the right lapses, leaving the sign open to third-party applications.

The window and the grace period

Renewal is requested, and the fee paid, within the six months before expiry. If that window closes, a further six-month grace period runs from the expiry date against an additional fee — under the 2026 schedule, roughly double the standard renewal fee for the same two classes.

Partial renewal

A mark can be renewed for all or only some of its classes. Ten years in, most specifications no longer match the business, so renewal is a natural moment to prune — balanced against the defensive value of keeping competitors out and the non-use cancellation risk of holding classes you never use.

If both periods are missed

• Protection restarts from the new filing date; all seniority is lost.
• Any application filed in the meantime now ranks ahead of yours.
• The five-year use requirement starts again.
• The mark is re-examined on absolute and relative grounds and may be refused today even though it registered without difficulty a decade ago.
